ORDINANCE NO. 541-14

AN ORDINANCE OF THE CITY OF SCRIBNER, NEBRASKA, AMENDING SECTION 5-122, SUBSECTION 1 OF THE ZONING ORDINANCE, RELATING TO METAL ROOFING GUIDELINES; REPEALING SECTION 5-122, SUBSECTION 1 AND ALL ORDINANCES IN CONFLICT; AND PRESCRIBING THE TIME WHEN THIS ORDINANCE SHALL BE IN FORCE AND TAKE EFFECT.

BE IT ORDAINED BY THE MAYOR AND COUNCIL OF THE CITY OF SCRIBNER, NEBRASKA, AS FOLLOWS:

Section 1. That Section 5-122, Subsection 1 of the Scribner Zoning Ordinance, Metal Roofing Guidelines, which currently reads:

  1. Vertical ribbed metal roofing sheets shall be allowed subject to the following standards:
    a. Roofing will be a minimum of 29 gauge with 1.00 inch rib height.
    b. All metal roofing will be factory finished solid color.
    c. No metal roofs shall be painted or repainted after installation.
    d. All metal roofing shall be installed with hidden fasteners (clips). No exposed fasteners, clips, screws, or nails will be allowed for purposes of securing the roofing material to the structure.
    e. Only factory manufactured trim, flashing, and vents will be allowed.
    f. Darker colors are encouraged to minimize glare and reflection.
    g. The metal shingles designed to mimic lap shingles or tile previously allowed or excluded from the prohibitions set out in the provisions of this Section 5-122, Subsection 1 a. shall continue to be allowed.
    h. The flat roof sections covered by a continuous, seamed or welded sheet previously allowed or excluded from the prohibitions set out in the provisions of this Section 5-122, Subsection 1 a. shall continue to be allowed.
    i. Reflective metal roofs can be constituted as a public nuisance, which may force removal at the owner’s expense.
    shall be amended to read as follows:
  2. Standing seam steel roofing sheets shall be allowed subject to the following standards:

a. Roofing will be a minimum of 29 gauge with 1.00 inch rib height.
b. All metal roofing will be factory finished solid color.
c. No metal roofs shall be painted or repainted after installation.
d. All metal roofing shall be installed with hidden fasteners (clips) and attached to manufactured trim, flashing and vents per manufactures’ recommendations.
e. Only factory manufactured trim, flashing, and vents will be allowed.
f. Darker colors are encouraged to minimize glare and reflection.

g. The metal shingles designed to mimic lap shingles or tile previously allowed or excluded from the prohibitions set out in the provisions of this Section 5-122, Subsection (1)( a) shall continue to be allowed.
h. The flat roof sections covered by a continuous, seamed or welded sheet previously allowed or excluded from the prohibitions set out in the provisions of this Section 5-122, Subsection( 1)( a) shall continue to be allowed.
i. Reflective metal roofs can be constituted as a public nuisance, which may force removal at the owner’s expense.

Section 2. The original Section 5-122, Subsection 1 of the Scribner Zoning Ordinance and all other ordinances and parts of ordinances passed, approved and, published or posted prior to the passage and approval of this ordinance and in conflict herewith are hereby repealed.

Section 3. This ordinance shall take effect and be in full force from and after its passage, approval and publication or posting according to law.
