ORDINANCE NO. 487-06

AN ORDINANCE OF THE CITY OF SCRIBNER, NEBRASKA, AMENDING ORDINANCE #241 KNOWN AS THE ZONING ORDINANCE Of THE CITY OF SCRIBNER, AND REVISING ARTICLE 2 DISTRICT REGULATIONS OF ORDINANCE # 241 CODE, RELATING TO THE SETBACK REQUIREMENT GUIDELINES IN THE RESIDENTIAL DISTRICTS OF THE CITY OF SCRIBNER; REVISING ARTICLE 2, SECTION 2-102 (D) (2), REPEALING ANY SECTION AND ALL ORDINANCES IN CONFLICT WITH THIS ORDINANCE AND PRESCRIBING THE TIME WHEN THIS ORDINANCE SHALL BE ITS FORCE AND TAKE EFFECT.

BE IT ORDAINED BY THE MAYOR AND COUNCIL OF THE CITYOF SCRIBNER, NEBRASKA:

Section 1. Article 2 of Chapter 102 of Ordinance # 241 of said City, is amended to add (f) to (D) Setback Requirements (2) as follows:

(D)  Setback Requirements. 

            (1)  Minimum yard setbacks contiguous to all County roads and Stage highways:  50 feet.

                        (2)  Minimum yard setbacks contiguous to all other roads and streets:

                                    (a)  Minimum front yard:  25 feet.

                                    (b)  Minimum side yard:  eight (8) feet.

                                    (c)  Minimum rear yard:  25 feet.

(d)  The entrance side of a garage or carport shall be set back at  least 25 feet from the access street, except that in the case of an alley, the entrance shall be set back at least five (5) feet from the rear lot line.

                                    (e)  Minimum side yard:  12 ft. on corner lots only.

(f) On lots plated after January 1, 2007 lots minimum street side yard:25 feet.

Section 2. All ordinances and parts of ordinances passed, approved and, published or posted prior to the passage and approval of this ordinance and in conflict herewith are hereby repealed.

Section 3. This ordinance shall take effect and be in full force from and after its passage, approval and publication or posting according to law.

ORDINANCE NO. 451-03

AN ORDINANCE OF THE CITY OF SCRIBNER, NEBRASKA, AMENDING ORDINANCE #241 KNOWN AS THE ZONING ORDINANCE Of THE CITY OF SCRIBNER, AND ADDING TO ARTICLE 5 SUPPPLEMENTAL PROVISIONS OF ORDINANCE # 241 CODE, RELATING TO THE REGULATION OF METAL ROOFING GUIDELINES IN THE RESIDENTIAL DISTRICTS OF THE CITY OF SCRIBNER; ADOPTING ARTICLE 5, SECTION 5‑122 OF ORDINANCE # 241, REPEALING ANY SECTION AND ALL ORDINANCES IN CONFLICT WITH THIS ORDINANCE AND PRESCRIBING THE TIME WHEN THIS ORDINANCE SHALL BE ITS FORCE AND TAKE EFFECT.

BE IT ORDAINED BY THE MAYOR AND COUNCIL OF THE CITYOF SCRIBNER, NEBRASKA:

Section 1. Article 5 of Chapter 122 of Ordinance # 241 of said City, as added, as follows:

That Article 5‑122 be added as follows: 5‑122  METAL ROOFING GUIDELINES.

            Residential Zoning:

  1. Basic guideline is no metal roofing attached with exposed fasteners be allowed.
    1. This excludes certain approved metal shingles designed to mimic lap shingles or tile.
    1. This also excludes flat roof sections covered by a continuous, seamed or welded sheet.
  • Permits must specify a particular type or form of roofing or siding.
    • No vertical sheet siding is allowed.
    • Steel siding does not constitute metal roofing applied to sidewalls.
    • Any roofing or siding must be of uniform color, except for trim areas.
    • This does not apply to metal window trim, soffit, fascia or associated trim
    • Steel or aluminum horizontal lap siding is allowed along with appropriate trim.
    • Any generally recognized steel ribbed roof sheets are specifically not to be used in a residentially zoned area.
    • This does not apply to commercially built utility sheds no larger than 8 ft by 12 ft or to approved commercially built car ports.

Commercial Zoning:

  1. Metal roof sheeting is allowed on all commercially zoned areas.  Recommended product is standing seam or high ribbed.
  2. Fascades and frontages may also be covered with or trimmed with metal.
  3. All metal buildings are allowed given zoning restrictions are followed.
  4. By following zoning boundaries building exteriors are kept aesthetically autonomous and eliminate any conflict.

Section 2. All ordinances and parts of ordinances passed, approved and, published or posted prior to the passage and approval of this ordinance and in conflict herewith are hereby repealed.

Section 3. This ordinance shall take effect and be in full force from and after its passage, approval and publication or posting according to law.
