ORDINANCE NO.  462-04

AN ORDINANCE OF THE CITY OF SCRIBNER, NEBRASKA, AMENDING ARTICLE 5‑115 OF ORDINANCE #241, RELATING TO SWIMMING POOLS; REPEALING SAID SECTION AND ALL ORDINANCES IN CONFLICT WITH THIS ORDINANCE AND PRESCRIBING THE TIME WHEN THIS ORDINANCE SHALL BE ITS FORCE AND TAKE EFFECT.

BE IT ORDAINED BY THE MAYOR AND COUNCIL OF THE CITYOF SCRIBNER, NEBRASKA:

Section 1. Article 5 of Chapter 115 of Ordinance # 241 of said City, as amended, is hereby amended as follows:

That Article 5‑115 be amended as follows: Article 5‑115 SWIMMING POOLS.

DEFINITIONS:  Swimming Pool – Meaning any permanent underground pool.

A swimming pool may be permitted in any district as an accessory use subject to the following additional requirements:

(A)  No public or private swimming pool may be located in any required front yard or side yard abutting a street.

(B)  Every swimming pool must be completely surrounded by a fence or wall not less than 48 inches in height with no openings large enough to permit children to pass through other than gates or doors that can be fastened to protect against entry.  A dwelling house or accessory building may be used as part of such required enclosure.

(C)  All gates or doors opening through such enclosures must be equipped with a self-closing and self-latching device for keeping the gate or door securely closed at all times when not in actual use.

Section 2. All ordinances and parts of ordinances passed, approved and, published or posted prior to the passage and approval of this ordinance and in conflict herewith are hereby repealed.

Section 3. This ordinance shall take effect and be in full force from and after its passage, approval and publication or posting according to law.
