ORDINANCE NO. 545-15

AN ORDINANCE OF THE CITY OF SCRIBNER, NEBRASKA, AMENDING SECTION 92.25 OF THE SCRIBNER MUNICIPAL CODE CONCERNING FIREWORKS REGULATIONS; PREPEALING ALL ORDINANCES OR PARTS OF ORDINANCES IN CONFLICT; AND PROVIDING FOR AN EFFECTIVE DATE.

BE IT ORDAINED BY THE MAYOR AND COUNCIL OF THE CITY OF SCRIBNER, DODGE COUNTY, NEBRASKA, AS FOLLOWS:

SECTION 1.  Section 92.25 of the Municipal Code of Scribner, Nebraska be and hereby is amended to read as follows:

SECTION 92.25  SALE.

A. It be and hereby is determined unlawful for any person to sell, hold for sale, or offer for sale as a distributor, jobber, or retailer any fireworks without first obtaining a license from the State Fire Marshal. Licensees shall only sell fireworks which have been approved by the State Fire Marshal.

B. Permissible fireworks may be sold at retail or offered for sale at retail within the City only from 8:00 a.m. on June 25 to 12:00 midnight on July 4 and from 8:00 a.m. on December 29 to 12:00 midnight on December 31 of each year.

C. It shall be unlawful to discharge, explode or use permissible fireworks before 8:00 a.m. and after 11:00 p.m. June 25 through July 3 and before 8:00 a.m. and after 11:00 p.m. December 29 through December 30.

D. On July 4 and December 31 each year, permissible fireworks may be lawfully discharged, exploded or used between the hours of 8:00 a.m. and 12:00 midnight.

E. Any person discharging fireworks at times other than those set forth herein shall be guilty of an offense and shall be fined in a sum not exceeding $500.00 for each offense.

SECTION 2. That all ordinances and parts of ordinances in conflict herewith be and same are hereby repealed.

SECTION 3. This ordinance shall take effect and be in full force from and after its passage, approval, and publication or posting as required by law.
